Terms of Service

1. Acceptance of Terms

By accessing or using the Zoogo platform, including our website at zoogo.pet, our mobile applications for iOS and Android, and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Zoogo is operated by Zoogo Inc., a company incorporated in the Province of Ontario, Canada ("we," "us," or "our"). We reserve the right to update or modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years of age to create an account and use the Service. If you are between 16 and 18 years of age, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or that violate these Terms.

4. Pet Profiles & Information

You are responsible for the accuracy of all pet profile information you provide, including health records, vaccination status, travel documents, and identification information. Zoogo does not verify the accuracy of pet health or medical information submitted by users and is not a substitute for professional veterinary advice.

You may share access to pet profiles with other users (e.g., co-owners, pet sitters, veterinarians). You are responsible for managing shared access permissions and understand that shared users will have access to the information you authorize.

5. PetSafe QR Tags

PetSafe QR Tags are physical products that link to digital pet profiles. By purchasing and using PetSafe QR Tags, you acknowledge and agree:

  • Each tag contains a unique QR code linked to your account
  • You control which information is displayed when your tag is scanned via privacy settings
  • When scanned, your chosen contact information may be shared with the scanner
  • Tags are not a guarantee of pet recovery and are provided as a supplementary identification tool
  • Tags may be reassigned to different pets by deleting and recreating profiles
  • Lost or damaged tags must be replaced with a new purchase
  • PetSafe QR Tags are not a substitute for microchips, municipal licenses, or other legal identification

6. Community Features

The Service includes community features such as photo and video sharing, comments, likes, and missing pet alerts. When using these features, you agree to:

  • Only post content that you own or have the right to share
  • Not post content that is abusive, harmful, threatening, or harassing
  • Not post misleading or false missing pet reports
  • Not use the platform for spam, unauthorized advertising, or solicitation
  • Not impersonate other users or entities
  • Respect the privacy and rights of other users and their pets
  • Not post content depicting animal cruelty or abuse

We reserve the right to remove content that violates these Terms without notice and to suspend or terminate accounts of repeat offenders.

7. Missing Pet Alerts

The missing pet alert feature allows you to notify nearby users, shelters, and veterinarians when your pet is missing. By using this feature:

  • You confirm that the pet is genuinely missing and the alert is truthful
  • You understand that alerts are sent to users within a geographic radius you specify
  • You consent to your contact information being shared with potential finders
  • You agree to promptly resolve or cancel alerts when your pet is found
  • Filing false missing pet reports may result in immediate account termination

Zoogo does not guarantee that missing pet alerts will result in the recovery of your pet. The effectiveness of alerts depends on the participation of nearby users and organizations. We are not responsible for the actions of third parties who respond to alerts.

8. Travel Information

Zoogo provides travel checklists and document management tools as informational resources only. Travel requirements vary by country and change frequently. You are solely responsible for:

  • Verifying all travel requirements with official government sources (e.g., CFIA, destination country authorities)
  • Ensuring all documents are current, accurate, and officially endorsed
  • Meeting airline-specific requirements for pet travel
  • Complying with all import and export regulations

Zoogo is not liable for denied entry, quarantine, or other consequences resulting from incomplete or inaccurate travel documentation.

9. Purchases & Payments

Payments for PetSafe QR Tags are processed through Stripe, a third-party payment processor. By making a purchase, you also agree to Stripe's terms of service. All prices are displayed in Canadian Dollars (CAD) unless otherwise specified. Applicable taxes are calculated at checkout.

Refund Policy: Unused and unopened tags may be returned within 30 days of delivery for a full refund. Shipping costs for returns are the buyer's responsibility. Damaged or defective tags will be replaced at no charge. Activated tags (linked to a pet profile) are not eligible for return.

10. Verified Business Accounts

Verified badges are available to legitimate pet-related businesses upon application and verification of business registration. Verified accounts may post promotional content in the community feed. Misuse of verified status, including misleading promotions, selling prohibited items, or promoting products harmful to animals, will result in loss of verified status and potential account termination.

11. Intellectual Property

The Service, including its design, features, code, and branding, is the property of Zoogo Inc. and protected by Canadian and international intellectual property laws. You retain ownership of content you upload (photos, videos, text). By uploading content, you grant Zoogo a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and promoting the Service.

You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Zoogo Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

  • Loss of, injury to, or failure to recover a pet
  • Failure of QR tags, alerts, or notifications to function as expected
  • Inaccuracies in travel requirements or health documentation guidance
  • Actions of other users, including false reports or misuse of shared information
  • Service interruptions, downtime, or data loss
  • Unauthorized access to your account or data

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Our total liability to you for any claim shall not exceed the amount you paid to Zoogo in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Zoogo Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Termination

You may delete your account at any time through the app settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. QR tags linked to deleted accounts will become inactive and may be reassigned.

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. We will provide notice of termination when reasonably possible.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Toronto, Ontario, Canada.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
